Got a 2nd opinion from another lawyer about my daughter's open warrant.
She looked up the case file and read the charge, misdemeanor DUI with probation requirements.
Initially, in 2016, my daughter agreed to do 40hrs of community service and pay for and complete a California-based and approved 18-month DUI program.
But, she said the same thing the 1st lawyer said. Since she only finished half of her probation requirements, she will have to serve 16 days in jail to clear the warrant.
The judge won't budge on an issue like this.
That is California.
They already have crowded prisons and jails. They're changing criminal laws to allow early release of many inmates.
Yet, they'd rather have someone with serious health issues do 16 days in jail than agree to pay a fine.
We're familiar with the California state prison system because we have family who have worked in it.
CA uses tons of taxpayer money for inmate healthcare.
But, county jails are a different story and they're all different. Their resources and funding are sometimes limited.
The lawyer told us that a person's health isn't a priority in county jail unless the incoming inmate can coordinate all of their healthcare needs beforehand.
She said that one lady was in their county jail and needed weekly dialysis, but almost died because she couldn't get the care she needed.
She told us that if my daughter wants to clear the warrant, the best thing to do would be to wait until she's healthier.
That could take years. Or, she may never be healthy enough to feel comfortable putting her needs in the hands of a jail's medical administrator.
So, the warrant will be there possibly forever or until she's healthy enough to resolve it.
