Under 8 U.S.C. § 1324(a)(1), harboring illegal aliens or aiding/abetting such acts carries a statutory maximum of 5 years (10 years if for financial gain). Conspiracy is up to 10 years. Serious bodily injury raises it to 20 years; death to life or capital punishment. Penalties apply per alien. The applicable guideline is USSG §2L1.1 with a base offense level of 12 (adjustable for number of aliens, profit motive, injury risk, and other factors).
Oscar Nunez, an illegal alien from Honduras, was charged with aggravated sexual battery, including two counts involving a child under 13. ICE lodged a detainer, but Fairfax County released him anyway without notifying ICE. Agents had to track him down themselves.
Sanctuary policies put predators back on the street. He never should have been released.
