I was quoted today in Fox News on the recent SDFL decision that held the statute that allows prosecution of illegal aliens who vote in federal elections is unconstitutional. The judge held this was because the federal government can’t dictate the qualifications of voters under the Constitution. Oddly, the primary rationale for the judge was Oregon v. Mitchell which held that the federal government CAN lower the voting age despite that being a voter qualification. The district court judge misread the splintered reasoning in that decision to create a messy opinion. But there are a multitude of other constitutional provisions that allow Congress to ban illegal aliens from voting in federal elections so I expect DOJ to win on appeal. foxnews.com/politics/activis…
