“15+ States Still Let Public Schools Paddle. D.C. Can’t Ban What Parents and Districts Already Decide”
There is no federal ban on spanking in public school. The Supreme Court left that to the states in 1977. About 15 to 18 states still allow it. Most of them are in the South.
Alabama, Arkansas, Florida, Georgia, Louisiana, Mississippi, Missouri, North Carolina, Oklahoma, South Carolina, Tennessee, Texas, Arizona, and Wyoming authorize it by statute. Indiana and Kansas have no statewide ban. Kentucky still has it on the books, but every district there has already killed it.
That is the truth. Legal does not mean every teacher swings a paddle.
Houston, Dallas, and Miami-Dade opt out. Rural districts keep the option. Florida now requires parental consent. Use has fallen for years. The paddlings that still happen cluster in Mississippi, Arkansas, Alabama, and Texas.
The fight is not “does America beat children.” The fight is who sets school discipline: a distant agency, or the people who live with the classroom.
States that kept the tool did not invent cruelty. They refused to pretend a federal rule would fix a kid who will not sit down.
If a district wants it gone, vote the board out. If a parent wants a consent form, demand one. Do not let Washington turn a local discipline question into another morality play.
