Yunan tarafının 12 mil çağrısı, Adalar Denizi’nin kendine özgü coğrafyasını, yarı kapalı deniz statüsünü ve uluslararası hukukun hakkaniyet ilkesini tamamen göz ardı etmektedir. BM Deniz Hukuku Sözleşmesi’nin 3. maddesi karasularının azami genişliğini 12 deniz mili olarak belirlemekte olup bu sınır otomatik veya zorunlu bir kural değildir; coğrafi ve hukuki koşulların elverdiği ölçüde uygulanabilir. Sözleşmenin 300. maddesi ise iyi niyet ilkesi ile hakların kötüye kullanılmasının yasak olduğunu açıkça hükme bağlar. Adalar Denizi’nde Türk anakarasına son derece yakın konumdaki binlerce ada, adacık ve kayalık ile iki ülke kıyılarının hem bitişik hem karşıt olması özel koşullar teşkil eder ve adaların tam etkisi ilkesinin bu bağlamda uygulanamayacağını ortaya koyar. Tek taraflı 12 mil ilanı Yunan karasularını mevcut yaklaşık yüzde 40’tan yüzde 70’in üzerine çıkarırken Türkiye’nin payını yüzde 10’un altına düşürecek, açık deniz alanını yüzde 51’den yüzde 19’a indirecek ve Türkiye’nin açık denize çıkışını fiilen Yunan karasularına mahkûm edecektir. Bu durum orantısız etki, kesme etkisi ve hakkaniyete aykırı sonuç doğurarak Lozan ile kurulmuş dengeyi bozar; Çanakkale ve İstanbul Boğazları üzerinden Karadeniz’e giden üçüncü ülke gemilerinin seyrüsefer serbestisini de ciddi biçimde kısıtlar. Türkiye’nin sözleşmeye taraf olmaması ile ısrarlı itirazcı statüsü ve TBMM’nin 1995 tarihli casus belli kararı, Yunanistan’ın Adalar Denizi’nde karasularını tek taraflı olarak genişletmeye yönelik herhangi bir adım atması hâlinde hükümete, hayati menfaatleri korumak üzere askeri tedbirler dâhil her türlü yetkinin verilmesini öngörmektedir. Ayrıca 1997 Madrid Deklarasyonu’nda taraflar Adalar Denizi’ndeki hayati çıkarlarına karşılıklı saygı göstermeyi ve tek taraflı eylemlerden kaçınmayı taahhüt etmiştir. Lakin Yunanistan buna aykırı davranmakta ve maksimalist taleplerde bulunmaktadır. Adalar Denizi’nde deniz yetki alanları ancak iki kıyıdaş devlet arasında hakkaniyete uygun mutabakatla belirlenebilir. Similarly, the country that persistently denies the identity of the Turkish minority in Western Thrace and continues to violate the rights of Western Thrace Turks, particularly their educational and religious rights as well as their rights concerning life and property, in defiance of judgments of the ECHR, unfortunately, Greece. Reality is not shaped by your statements about so called defensive measures that are supposedly designed to address hypothetical threats but are in essence directed towards offensive purposes and are rather forcefully presented as somehow being connected to Europe, Mr. Minister. You are lying to the public and misleading your own people. Your country is violating international law as a whole. As long as people like Dendias continue to hold positions in Greek governments, it is hardly surprising that Greece has disputes with three of its four neighbours.
