One thing that shapes that trade-off is timing. Agency rules arrive in stages. The SEC proposal is open for comment until 20 October, while the CFTC package is still listed at prerule, so a proposed rule and its own comment period still have to follow. A statute sets the line in one step. Rules get there as well, but the version that binds is the last one, not the first.
