This is the same court that allowed Judge Emmet Sullivanâs personal prosecution of Gen Flynn to continue indefinitely after the DOJ dropped the charges.
As Iâve said many times, once a case has even the slightest connection to Trump, the law, the facts, the quality of the arguments, and the caliber of the lawyers making them all become totally irrelevant. The outcome is determined solely by which judges are assigned to the case.
Iâm going to post some clips today of oral arguments before the full (Dem loaded) DC appellate court related to restarting Jeb Boasbergâs criminal contempt case against Trump DOJ.
Judge Patricia Millettâan Obama appointee who was the first beneficiary of the ânuclear optionâ in 2013 and replaced John Roberts on the DC appellate courtâwas particularly unhinged that day.
Often pounding on the dias to emphasize her point and raising her voice, Millett badgered assistant attorney general for civil division Brett Shumate about the governmentâs opposition to Boasbergâs witch hunt.
Here, Millett raised unsubstantiated allegations by a so-called DOJ whistleblower who alleged then acting Deputy Attorney General Emil Bove said DOJ might have to say âf youâ to the courts in immigration mattersâknowing, of course, activist judges would do precisely what theyâve been doing.
Keep in mindâBove is now Millettâs colleague on the Third Circuit Court of Appeals. She is suggesting Bove could be investigated by Boasberg WHICH IS INSANE. (But also what Boasberg wants as well.)
But not only is she slamming her colleague on baseless accusations, Millett misrepresented his alleged comment.
Even if he said itâthe FU was not directly tied to Boasbergâs âoral commandâ to return planes on March 15.
This is just a taste of what the administration is up against in DC courthouse.
Give it a listen.
