Here is my proposal for diesel exports and an America First fuel policy that preserves flexibility and exploits revenue maximization: Don’t ban diesel exports. License them. A blanket ban is dumb. US refiners are the swing supply (~20%) for a tight global diesel market. Kill the export outlet and they cut production runs, and you lose gasoline too, and allies eat a shortage we created. Do this instead: Every diesel producer needs an export license. The license lets them export only up to an “export percentage ceiling” — X% of that plant’s diesel production. The rest cannot clear Customs. Cut production and your allowed exports fall with it. Maximizing profits and revenues means maximizing output. Government raises X when inventories recover. Licensed barrels go only to countries on an eligible-destination list. Allies see less disruption than others. That is not retail rationing and it is not a price control. It is a condition on the privilege of exporting during an external supply shock. Authorities: 🖋️IEEPA, 50 U.S.C. § 1702 — after an emergency finding, the President may regulate or prohibit exportation “by means of instructions, licenses, or otherwise,” including destination limits. 🖋️National Emergencies Act + the existing energy emergency declaration — the foreign-source threat finding (Hormuz / Russia / lost refining). 🖋️ Export Control Reform Act / EAR — Commerce can require licenses and put quantitative and destination conditions on them.
