Colorado's Taxpayer's Bill of Rights (TABOR) limits the amount of revenue the state can retain and spend without voter approval. To fund public services without triggering TABOR caps, the General Assembly has increasingly designated state programs as government-owned enterprises. These enterprises are legally exempt from TABOR limits because they are funded primarily through user fees and service charges rather than direct taxes. As a result, fee-based revenue grew from $742 million in FY1994 to $28.2 billion in FY2025. According to research by the Common Sense Institute, if all services funded through Colorado's fee enterprises were replaced by income tax revenues, the state’s flat income tax rate would need to rise from 4.4% to 14.22% to cover the cost. Even excluding higher education tuition, the tax rate would need to reach nearly 8%.
