THIS is the part that should make people furious. Dr. Idris Evans dedicated his career to saving critically ill children. Now he is dead, his wife is critically injured, and their two children have been left traumatized after an attack inside the place they should have been safest—their own home. Police arrested 32-year-old Elijah Hemingway and charged him with criminal homicide, attempted criminal homicide, aggravated assault and other offenses. But here’s the part I cannot get past: Hemingway was reportedly already OUT on non-monetary bail in an unrelated burglary case. How many times are families supposed to pay the price when someone accused of a crime is released back onto the streets? Gina Evans was stabbed and STILL managed to get her 8- and 12-year-old children out of that house alive. Those children escaped physically unharmed—but they lost their father and watched their mother fight for her life. Dr. Evans spent his life trying to save other people's children. Who was protecting his? Pray for Gina and those babies. 🙏🏻💔

Important to note that Jack Smith knew he had judges--including Beryl Howell and Jeb Boasberg--in his back pocket. They not only conducted zero oversight of his rogue operation, they quickly issued nondisclosure orders for several subpoenas including Howell's egregious NDO on Smith's demand for the president's Twitter data, which clearly violated Trump's executive privilege rights (as the DC appellate court noted after it was too late.) One way to fix this is to revise the Stored Communications Act to require judges to perform more due diligence before authorizing an NDO. The judge should be required BY LAW to attach any findings of potential obstruction or threats to witnesses if the target is notified of the search--and certainly any evidence of the target representing a flight risk, as Howell did in the Twitter case (only to pull it back before the documents went public.) This--along with impeachment of those judges--can put an end to this in the future. But unfortunately we've seen no action on any front to hold the judges, who are ultimately responsible for conducting oversight of these matters, accountable.

According to a new filing in the old classified documents case (h/t @joshgerstein), several former FBI agents/ analysts involved in the raid of Mar-a-Lago in 2022 have received requests for interviews and subpoenas related to the "grand conspiracy" investigation into the raid ongoing in southern Florida. The investigation, now led by the US Attorney for the Southern District of Florida following the recent departure of Joe diGenova, appears focused on at least two potential crimes: Conspiracy Against Rights and Deprivation of Rights Under Color of Law. Defense attorneys--including Abbe Lowell and Mark Zaid--representing the unnamed FBI employees believe any testimony would run afoul of Judge Cannon's gag order in the matter, which relates to any leaks of Volume II of Smith's final report. This sounds like a stretch but at least confirms significant movement in the investigation.
