DV-2026 Update: in Medani v Trump, Judge Davila has set a hearing for Tuesday afternoon at 4:30 PST on plaintiffs’ motion for supplemental relief (in the form of reserved unused visas).

DV-2027 update: Hearing in REL v Rubio is over. Since our last hearing, the judge, like us, has done a lot of work to understand the case law around the “zone of interest” issue, and recognizes just because it is unique for a law firm to be the plaintiff challenging an immigration policy does not mean the law firm is not in the zone of interest. Also, she understands how serious the case is. Also, she committed to provide an order on our motion for preliminary injunction on or before October 14. Journalist Quinn Welch with @CourthouseNews was present, so a story is likely forthcoming.

DV2027 update.

In Ivanov v Trump, Judge Leon has ordered the Trump administration to file a response to plaintiffs' motion for supplemental relief (including the contempt issue and reservation of unused visas) by September 28, 2026, at 12:00 PM. 🚨DV-2026 Update. This morning, a government attorney in Ivanov represented that "we do not believe the Plaintiffs in the Ivanov consolidated case are members of Medani." This is problematic for the government in Medani because status reports that have been submitted to Judge Davila to demonstrate compliance have included stats mostly for Ivanov plaintiffs. A reminder of something I like to call the Curtis Rule. When you are issued a visa and you have it in your hands, you go to the airport and you fly to the USA. Until you enter the USA with that visa, you are not a lawful permanent resident, and you are not protected by the US Constitution. It is only a piece of paper.
