The evolving landscape of counter-space capabilities is raising new questions about the legal and strategic boundaries of military activity in outer space. When Weapons in orbit are publicly confirmed, the question arises: Are old space laws ready for a New Era? While the Outer Space Treaty prohibits placing nuclear weapons and other weapons of mass destruction in orbit, contemporary capabilities—including electronic warfare, cyber operations, proximity operations and satellite manoeuvrability—are creating challenges that were not fully anticipated when the existing space-law framework was developed. For India, the issue is particularly significant. With space increasingly supporting defence communications, navigation, intelligence and surveillance, weather services, disaster management and civilian connectivity, a contested orbital environment could have consequences well beyond military satellites. The emerging BRICS Space Council could also provide an important platform for India and other Global South space actors to help shape norms around an increasingly contested orbital environment.
