Ariely is a stain on @duke @DukeFuqua and @lemonade. I am appalled they have not fired him: two papers based on fraudulent data (retracted) and another two with “expressions of concern” over data. Duke Student Paper reports he appears 636 times in the Epstein files: "Would you send me the name and email of the redhead that was here with you? Seriously? What’s the concern you ask, @vladtenev? The list of concerns is almost existential. U.S. securities laws are in place to protect investors. For good reason, we spend millions and millions of dollars every year to comply with U.S. securities laws. In good. conscience, how can Robinhood as a U.S. company set up an operation in far offshore Jersey, an island 3000 miles away, and market a security sort of posing as AMC in some shape or fashion, and not comply with U.S. securities laws. That is shocking and shameful. Our past issuance of equity to strengthen our balance sheet was vital to our success. Your setting up some kind of fictitious synthetic equity market decouples stock token ownership from a company’s ability to control its own capital raising efforts. Share ownership gives shareholders various rights, including the right to vote their shares. Your stock token pretend to be some form of stock ownership, but disclosures to the contrary notwithstanding, they are not ownership and they deprive investors of their rights. This quasi-fake market you are creating on the island of Jersey sows distrust amongst the public about financial markets in general. There already is distrust in financial institutions, you are potentially making it far worse. These are but a few of my concerns about your actions. I hereby call on you and Robinhood to voluntarily CEASE AND DECIST the trading of AMC stock tokens. If you don’t, our high priced securities counsel has been asked to see whether we can force you to stop. I also wonder how can the SEC possibly support your sham ignoring of U.S. securities laws. You can be sure we will be asking them.

Charlie Portis rowed at Yale, graduated from Wharton in '86, and led a successful real estate career before founding Wateriders Kayak Tours - the first kayak rental in Chicago. Throughout its history, Portis has been navigating the unpredictable rain in Chicago, often being forced to cancel tours due to the forecast. Last week he found Kalshi's rain markets for the first time. Portis began to trade on the probability of the rain, watching the forecasts as he always does, but now putting small amounts on YES, for "will it rain tomorrow in Chicago." Given these contracts payout when it rains, they function as a "hedge," decreasing his lost revenue in the event of bad weather. There was a lot of commentary about how academic frauds get differential treatment. You know what? Let's show that this isn't the case by shaming Duke into firing Ariely.

Great coverage of the hearing in the Spagnuolo insider trading case. Defense citing (1) US v. Chastain for idea that the MNPI must have commercial value, and (2) the new 9th Circuit ruling that sports contracts on Kalshi are not swaps, not subj to CFTC. @Polymarket pushing the envelope again. @ChairmanSelig @MichaelSelig says no sports injury contracts [for obv reasons]. PolyUS self-certifies an injury contract. Makes a mockery of the self-certification regime, which is absolutely a gift to industry. If you abuse it, you may lose it.
Polymarket U.S. self-certified—and the CFTC has not opposed—NFL injury return date bets, per a filing today. This appears to run directly against the CFTC's own proposed rules for prediction markets (below)

CME knows that where there are markets, there will be bad actors trying to manipulate them. That's why CME has brought thousands of actions over the years for market manipulation. And that's a good thing! The response to bad actors isn't to throw away good products, it's to police and punish the bad actors.
