In one, DOJ alleges a man obtained H-1B status through a family member’s company that provided: “No meaningful employment.” His supposed H-1B job? He actually worked as a taxi driver. In another case, DOJ alleges a woman sponsored a family member as an H-1B accountant through a company that: “Conducted no business and provided no meaningful employment.” DOJ says the petitions were filed so the family member could remain in the United States. These are allegations and have not yet been adjudicated. But the enforcement message is notable: The government isn’t just looking at current H-1B fraud.
