I was literally minding my own business until this asylum seeker news dropped. Seeing thousands of Ethiopians, Somalis, Pakistanis etc queuing up at home affairs made it even worse. 😭

And please spare us the journalism credentials. South African journalism is hardly the flex you think it is. You all suck and can’t even the basic journalism skills.
Yassass, I have never, in nearly 20 years of journalism and in 16 years of being on this app, seen so much wrong information about a judgment, the Constitutional Court and the law. I am dismayed.

Most importantly, we still have not heard Home Affairs’ actual plan for dealing with the consequences of this judgment. The Department itself has acknowledged that it expects to be overwhelmed and lacks sufficient capacity. That cannot be where the explanation ends. The Constitutional Court judgment is final and must be implemented, so what is the operational plan now? How will applications be expedited, backlogs prevented from growing, security and identity checks conducted, appeals processed faster and unsuccessful applicants dealt with once all legal processes are exhausted? What additional staff, funding and systems are being put in place? South Africans deserve more than “we don’t have capacity”. Dear Ministers @Khu_Ntshavheni , @SollyMalatsi and @Leon_Schreib Could you kindly urge government communications not to miss the opportunity to explain in detail the Constitutional Court’s judgment concerning access to the asylum process. Owing to how contentious immigration is at the moment and how easily this judgment can be distorted and manipulated, its meaning and implications must be unpacked across all SABC radio stations, television current affairs programmes and social media, in languages citizens understand. Concerns are also being raised about claims of a sizeable contingent of Pakistani asylum seekers who are said to be of military age and fears that some might pose a security risk. There are also questions about the apparent ‘predominance’ of male asylum seekers over females. Government should attend to these concerns and not dismiss them as though South African citizens are being irrational or paranoid. The state through its Intelligence, must establish the facts, explain its screening procedures and address any substantiated risks. Citizens deserve clarity and correct information. The government commutations machinery as the custodian of the sovereignty must prevail and lead on these issues. A widening information gap leaves room for assumptions and conspiracy theories, further fuelling tensions and anxieties.

You can’t issue statements like this and expect blind trust when this is the state of our immigration system. Thousands lining up at Home Affairs today, porous borders and recurring cases of undocumented people entering the country. Your credibility has to come from results, not statements.
THE BMA DISMISSES CLAIMS THAT DEPORTEES ARE ENTERING SOUTH AFRICA THROUGH INFORMAL BORDER CROSSINGS The BMA has noted claims that deportees are entering South Africa through informal border crossings and wishes to clarify that South Africa’s land Ports of Entry with the Kingdom of Eswatini are secured, with access control measures implemented at designated entry and exit points. The BMA dismisses claims that deportees are entering South Africa through informal border crossings. The BMA supported by other law enforcement authorities maintains a presence across the country’s Ports of Entry and continues to conduct border surveillance and enforcement operations to prevent and detect unlawful entry, including the smuggling and trafficking of persons. It is imperative to understand that any person who is in transit through South African Airports go through international transfers without entering the Republic. Therefore, any attempt to circumvent formal Ports of Entry is subject to detection and enforcement action. #SecureBordersForDevelopment

JUST IN : I just spoke to the Eswatini government spokesperson Thabile Mdluli. She says she doesn’t want to come on air or to confirm whether or not any of the criminals travelled via South Africa. I tried to press her and asked “but can you assure us that they were not released to transit via SA?”, she responded with “We are not revealing the transit countries, Clement.” We don't want to cause unnecessary panic” she says. @ClaysonMonyela don’t you think it’s weird that they are refusing to confirm that these criminals didn’t transit via SA upon their release?

the “official record” does not answer the allegation. It says they returned to their countries and that other countries facilitated their “transit”. Which countries? Which routes? Did they transit through South Africa, yes or no? Dressing an unanswered question in diplomatic language doesn’t make it answered. Sit this one you are just a mouth piece for the department. @ClaysonMonyela did you guys investigate??
Thank Sis @phakxx for elevating this matter. In an age confounded by misinformation and disinformation, the official record must be consulted with rigour. The Statement by the Government of Eswatini therefore merits full and fair consideration in the debates unfolding across these platforms an authoritative contribution deserving of serious, impartial attention.

Oh it’s you again. Well declaring everyone who disagrees with your interpretation “misinformed”, “hysterical” or part of a “disinformation campaign” doesn’t make you the final authority on the law. People have read the judgment and are perfectly entitled to oppose its practical consequences and demand legislative reform. You don’t get to debate yourself and declare yourself correct. For someone who studied law you really suck at it you should consider changing careers because at this point it’s embarrassing.
There’s clearly and active disinformation about the Concourt judgment on asylum seekers. The hysteria is not factual. There’s nothing new in the judgment that was not there for the 20 years up until 2024, when Home Affairs changed the law in violation of international law.

And don’t omit the fact that determining an asylum claim can take years. A six month permit can be renewed while the case remains pending and during that time asylum seekers may access certain rights and services in South Africa including the SRD grant. That prolonged limbo is exactly why South Africans are frustrated.
Don’t omit the fact that the permit is only valid for 6 months, and the fact that the application process allows the Department to collect biometric data, which is crucial if any of them commit a crime.
