Those affected by the infected blood scandal are asking for that same kind of meaningful, ongoing engagement — not simply meetings, but conversations that lead to clear answers and visible action. Glass-Steagell, Dodds-Frank, the Volcker Rule all went some way to restrict US Banks leverage & risk. The UK however, in the early to mid 2000's was the centre for Over the Counter (OTC) derivative trades with the EU heavily tied in. In September 2008 Lehman's did a US Chapter 11 & effectively dropped a 'dirty bomb' in EU financial markets. Compare economies and growth since 2008 on. I didn't write to Martin Wheatley & @TheFCA in 2013 about Hidden Credit Lines, I alleged that the banks were relying on/trading SME's assets as collateral in their trading books. The FCA said I was getting confused with Repo deals, I wasn't... I was alleging the banks were relying on ISDA deals, All Monies Charges & undisclosed margin credit lines to pool clients assets as direct 'counterparties' in their trading collateral, Lehman's style. Effectively treating them as Repo deals without transferring the title, the FCA's post Markets in Financial Directives (MiFID) interpretation of the Rules allowed that. It didn't work on paper, it didn't comply with the regulations but that did little to stop them. The Terms of Business set out the risks clearly but SMEs either didn't receive them & if they did certainly didn't understand them. Treating car salesmen, carpet salesmen, farmers, landlords etc. as investment professionals capable of trading complex and long term derivatives against them, one on one. Complex Financial Instruments, derivatives sold Execution Only (no advice), was a direct contravention of the MiFID directive and the reason for its drafting. The banks had Bloomberg terminals telling them their immediate profit from undisclosed swap margins (they would lie about the market swap rate and add circa 0.5% on) and the expected credit liability from future losses. They stated it was a no premium deal whilst hiding the commission (added value) and ongoing/future risk in a Hidden Credit Line. When rates dropped they kept increasing margin credit against the customers property, in the customers name without telling them. When the banks ran out of equity, they were left with the increasing risk & the only way to resolve that was bust the client, take the property on to their own books and cover the risk in full with that equity. They could write down the debt, bust the customer, recover the full collateral & then like @NatWestGroup buy the customers assets, re-value the assets again -because there was no longer a default risk (HM Treasury underwrote the risk) and massively profit from the customers forced insolvency. That's why the FCA's appalling IRHP Review Scheme could not be based on the Rules, almost all of them had been broken & virtually all SME's would be owed their money back & consequential losses. So the FCA got all of the Skilled Persons who would act on the Review in & agreed the 'Sales Standards' instead of the Rules. They instructed all of them, don't consider contingent liabilities (the risk that led to the Hidden Credit Line fraud) & don't consider the undisclosed fraudulent credit facilities that led to the destruction of tens/ hundreds of thousands of SMEs. A state sponsored cover up. Then consider the Barclays traders/ managers/ Directors involvement in the Ricardo Cayman's offshore funds. Built to profiteer from these deals. Consider Aubrey Adams ex Savills CEO seconded into & then head of property in @NatWestGroup GRG whilst being Chair of the Jersey based REIT 'Max Property' working with Nick Leslau. The fund was set up in 2009 specifically to benefit from the purchase of distressed UK commercial property, what a coincidence... Then the City Minister @JohnGlenUK told Parliament @hmtreasury would not confirm which @NatWestGroup Asset Protection Scheme 'covered assets' ended up on the West Register Books, it was commercially sensitive he said. I bet it was, to those who made millions from the pre-meditated asset stripping. Interesting that the Land Registry system that previously produced Titles that confirmed every previous owner of property, only recorded 1 last owner as all of these assets were stripped & properties bought & sold by bank and Government connections. The evidence was sensitive to the little gang 'filling their boots', buying assets many SME's had spent a lifetime building for 10-20% of real market value. A state sponsored cull and theft of SMEs funds, the same SMEs who had & continue to, drive the UK economy, since 2008 with little or no support from the bailed out banks. Millionaire became Billionaires within a few years. When I wrote to them, the Hidden Credit Lines were I believed such an obvious element of that scandal, the FCA would have to admit it immediately. 13 years later they are still denying it & misleading Parliament. In my humble opinion the FCA are little more than an organised crime cover up syndicate, hiding the crimes in plain sight. I grew up in a depression, when Thatcher's policies were destroying mining, the Unions, the North and saw whole villages/areas devastated by her bowing to Milton Friedman's promotion of 'market forces'. I genuinely fear that if confidence in the authorities continues to collapse, some people will eventually try to take matters into their own hands. I don’t think it is accurate to say that Whistle-blowers UK was “singled out” by the documentary. WBUK & the proposed Office of the Whistle-blower were central to the concerns the documentary set out to examine. The programme raised specific questions about governance, accountability, funding, commercial interests and the structure being proposed for the Office. WBUK featured prominently because of its role in developing and promoting that model and because concerns had already been raised about those matters. Very similar concerns have been raised about the FBB APPG, which has failed to expose the real frauds on swaps & FRL's for years whilst allegedly representing victims of those frauds but still accepting bank funding. That is quite different from selecting WBUK as an arbitrary target. Whether people agree with every conclusion reached by the documentary is a separate question, but the reason WBUK featured so heavily was apparent from the subject matter being investigated. 🔹For my followers (including eminent silk & Irish judiciary) who are still struggling with comprehending the breadth & scale of the frauds inside the Hidden Credit Line Scandal. 🔹Put yourself in the position of a hotelier, farmer, estate agent - or anyone running an SME & having borrowed from Ulster Bank or Bank of Scotland Ireland. 🔹You thought you had one loan. 🔹You didn’t. 🔹You already had a floating-rate business loan in Ireland. 🔹The rate moved with the market. 🔹That was the deal: one debt, one property, one limit. 🔹Then the bank said: We’ll fix the rate so you can sleep. 🔹I am saying that “this fixing” meant the bank quietly opened a second debt in your name. 🔹You never got the cash. You couldn’t spend it. It still sat against the same shop, pub or yard or whatever security you agreed previously to back the loan. 🔹Then rates plunged. 🔹That hidden number blew up. 🔹On your statements you still looked fine. ‼️🔹On the bank’s screen you had “broken the rules.” ‼️ 🔹Then they could & did squeeze you. 🔹The part people miss: the fall in rates was not just bad luck 🔹Your loan and that hidden extra were priced off the same official rates — Libor and, in Ireland, Euribor. 🔹Those rates did not only fall because the economy crashed or “market conditions”. 🔹Traders at big banks pushed the published numbers around to help their own books. [RBS — Ulster Bank’s parent — was fined for this. The UK watchdog fined RBS £87.5 million over Libor. The EU fined RBS about €131 million as part of a Euribor cartel with other banks. The US piled on more. The misconduct ran through the same years as these SME loans.] 🔹So the story is not: rates fell, hard luck. It is this & please share: ‼️🔹the bank booked a secret extra debt against you, then the same banking system that set the rate was caught rigging that rate — and when the number moved against you, they used it to say you were in breach.🔹‼️ The Irish court system has facilitated enforcement against you - much like it facilitated enforcement of Anglo loans against Quinn despite the “grotesque illegality” as identified by our current AG. In one picture • Loan 1: the floating loan you asked for. • Loan 2: an invisible bill for “undoing the fix,” alleged to be parked on your file. • The official rate that made Loan 2 explode: a rate banks were later fined for manipulating. The sentences to use 🔹I already had a variable loan. 🔹They offered a fix. 🔹They added a second, hidden debt to the same security. 🔹Rates were then driven down — and the parent bank was fined for helping rig those rates. 🔹That is when the hidden debt was used against me. The banks’ lawyers & @centralbank_ie said “Nothing to see here”. Much like Senan Allen. Below is my email to @APPGbanking on 23 May 2019 when they 'fixed' their broken link on their website so I could finally see who was funding them. I grew suspicious of the APPG in 2014 when the Chair Gueto Bebb, had promised to ask the FCA to meet with me to discuss my concerns over Hidden Credit Lines at a dinner in Wales, just a week later he refused & suggested he had never said that. He had - over 200 people heard him... @efgbricklayer was there & can verify the events. All of the Bully Banks directors were there, most of whom repeatedly told me I was wrong about this as they collected their membership fees and fabricated the names of hundreds of members, to pretend they had 2,000 members. That was the figure @TheFCA had told them they needed - 10% of the victim population to represent them all in negotiations with the FCA, on the IRHP Review - compensation scheme. Bully Banks directors told members they were chasing £30 billion with losses & consequential losses. The dire negotiations led to a paltry £2.2 billion & virtually no consequential losses. @TheFCA made every bank sign an undertaking their Review would comply with the 'Rules', then called all of the Skilled Persons in & replaced the Rules with the 'Sales Standards'. The Standards did not include consideration of the Hidden Credit Lines or their effect, which was to destroy tens of thousands of SMEs, with the undisclosed credit breaching Loan to Values and triggering SRM, GRG & BSU transfers and insolvency. Hidden Credit Lines on @UlsterBankNI & @LloydsBank Fixed Rate Loans were just a major fraud @TheFCA is still desperately trying to cover up despite @jameshurley 4 excellent articles in the Times. The FCA specifically excluded consideration of 'contingent liabilities' and credit lines, the banks lied that the losses were not 'foreseeable' and kept tens of billions stolen from SMEs. At the dinner in Wales, I was representing the widow of a victim, who on the verge of losing his home had taken his life to protect his widow, the bank had enforced a PG based on an undisclosed £190k swap credit line & was going to sell the house to collect its profits from the fraud. At the same time Bully Banks directors were staying in a 2 bed flat in London, with expense cards paid by victims contributions, whilst I and others supported the victim & his wife pro bono because they had no money. Bully Banks choice of lawyers Slater & Gordon wanted £2k on the table before they would even read the file & refused to help. Five years later the APPG allegedly representing swap & Fixed Rate Loan victims, still would not expose the fraud. Victims I explained the Hidden Credit Lines to, approached the Secretariat and then Chair @kevinhollinrake who refused to write to the banks on the matter. The funding I exposed below & the people the APPG were promoting to represent victims, amongst other concerns, led to an MP with integrity @normanlamb step down as Co Chair just as he did from the whistleblowing APPG when @CompassnInCare exposed similar concerns about WBUK. Sir Norman had not been aware of it because rather than disclose it on the Parliament website @NatWestGroup and the other banks paid the money to the Secretariat, who then donated it to the APPG... Was it my exposing the bank funding that led to them blocking me on X, or might it be because I allege that they along with @TheFCA have misled Parliament about this magnitude and effect of this fraud since inception? Or was it my reporting that the APPG's Director of Policy and head of the Secretariat had the benefit of a 3 bed flat in Horseferry for 2 years around this time worth circa £50k pa provided by @SMEAllianceLtd Directors. Or the fact that I raised my concerns that the same directors were then promoted them as stakeholders on the sham BBRS compensation scheme & the @LloydsBank morally bankrupt Foskett Compensation schemes. Or perhaps is it because I reported my concerns that a Parliamentary staffer was failing to declare such a substantial benefit and I have the evidence that the Commons Registrar was misled about the benefit. Bebb got the Tory 'Whip' role after Chairing the APPG, an interesting promotion for someone allegedly taking on banks & @TheFCA but then he never was successful on either front... The @SMEAllianceLtd directors quadrupled their compensation in the Foskett Panel after agreeing new Rules in the Foskett panel that destroyed the compensation rights of many REAL victims. Victims bankrupted because of the fraud then faced the same fate again. The BBRS set up to provide redress to 60,000 victims paid millions out to its Board, peanuts out to about 6 victims then shut down. Controlled at the start by the banks via a hidden membership, it was a sham, a con, promoted by @APPGbanking & @SMEAllianceLtd in conjunction with @UKFtweets Sir David Foskett broke his promises of meeting with any victim, even if they had a Trustee. His team refusing David Morgan's widow a meeting on 5 occasions. Leaving her to fight a fee hungry Trustee, collecting funds for non existent debts & failing to investigate potentially fraudulent proofs of debt. Perhaps its time to stop letting the Banks & FCA pick their usual 'safe pairs of hands', to negotiate with now the largest financial fraud in living memory is going to be exposed. If the Public Inquiry we are demanding leads to the tens of billions of assets stolen from SME's being returned with interest, possibly the largest boost to the economy & Revenue available, then those same bad actors must be nowhere near any discussions or negotiations.
