States are free to create laws as long as they don’t violate Fed laws. To the best of my knowledge, States haven’t violated Fed laws on this topic ICE violates the Constitution’s Due Process Clause. Also withhold evidence in their killings. These violations trigger scrutiny.

If they detain someone with an order of removal then due process has been served. I don’t disagree that it is a gray area recently with Trump but let’s not forget that President Obama did the same process, he just didn’t get the protests and anti-ice brigade.

ANYTHING “can be argued”, but every time these arguments (Administrative Warrants, etc) have been adjudicated in courts, those arguments have lost. States have a duty to uphold laws.

States have a duty to uphold state laws but federal laws do carry more weight. I’m still struggling to see where ICE has violated our constitution. When previous administrations executed immigration laws they weren’t scrutinized like this one has been.

It can be argued that under the INA they are within their rights under the constitution. The lawmakers, Blumenthal included, granted those powers. If states worked with them instead of against a lot of the issues there have been would not have occurred.
