(p 19) On who caused the delay: "The Court will not support defendants delaying in resolving the administrative proceedings and then fault plaintiff for filing suit." (p 19) On why a clerk gets to ask: She sued "to ensure that she, and derivatively her employer, Bridgewater Township, complies with state and federal law and therefore will not be criminally charged." (p 21) On the State calling her fear of prosecution speculative: "quite remarkable and reckless." The ruling says the gap between her "conspiracy" and what you paid at the pump was TOO GREAT to be a case at all. Also, that judge is a BIDEN APPOINTEE. I called this in January. All 23 pages. In character. Grateful for the continued attention to the case. A few hours after Rob recording, the judge ruled. THE CASE IN 30 SECONDS Benson's rule: delete the electronic poll book records 7 days after certification. Federal law: keep them 22 months. Destroying them early is a federal crime. A township clerk asked the State which law to follow. Eleven months. No answer. So she sued. Benson asked the judge to throw it out. WHAT ROB READS, FROM THE CERTIFIED TRANSCRIPT The State's lawyer, asked about the merits: "You're not going to hear a merits argument from me." (p 11) The judge, when the State said keeping records costs too much: "You're arguing practicalities. But you know what? I have to comply with the law." (p 11) The State, on what every other clerk in Michigan did with their records: "All the other jurisdictions have presumably purged their materials." (p 13) The judge, a former federal prosecutor, on the State's "nobody's been charged in 14 years" defense: "This is a new DOJ, different from the DOJ that I think I worked for." (p 8) The State's lawyer: "That's true, Your Honor." And for the record, the lawyer who walked in late was not me. That was the State's second attorney. I was at the podium, on time. HOW IT ENDED Hours after Rob stopped recording, the judge denied Benson's motion on every ground and kept the order protecting my client's records in place. BENSON ORDERED CLERKS TO DELETE ELECTION RECORDS. A CLERK SUED. BENSON ASKED A JUDGE TO THROW IT OUT. TODAY HE SAID NO. ON EVERY GROUND. THE CASE IN 30 SECONDS The electronic poll book is the laptop record of everyone who checked in to vote at your precinct. Michigan Secretary of State Jocelyn Benson's new state rule says clerks must DELETE it 7 days after the election is certified. Federal law says KEEP it 22 months. Destroying it early is a FEDERAL CRIME. My client, Bridgewater Township Clerk Michelle McQueer, asked the State which law to follow. ELEVEN MONTHS. NO ANSWER. So she sued. WHAT HAPPENED TODAY: - The Court of Claims denied the State's motion to dismiss. COMPLETELY. - The State said she waited too long. DENIED. The court: it "cannot fault plaintiff for waiting." The power to answer her "was completely in their hands." (pp 19, 21) - The State said she skipped the process. DENIED. The court: it "will not support defendants delaying in resolving the administrative proceedings and then fault plaintiff for filing suit." (p 19) - The State said a clerk can't bring this case in any court. DENIED. The court: she sued "to ensure that she ... complies with state and federal law and therefore will not be criminally charged." That's not the kind of case the State's cases are about. (pp 21-22) - And the order protecting her records STAYS IN PLACE. WHAT THE JUDGE WROTE: The State said criminal liability is "speculative" because DOJ hasn't prosecuted anyone yet. The judge, in Footnote 3: "The Court finds this contention to be quite remarkable and reckless." And Footnote 5: "Plaintiff's suit also could derivatively save the SOS from being criminally charged federally." READ THAT ONE TWICE. FROM THE HEARING, SEPTEMBER 16: - To the State's lawyer, first sentence: "Off the top, you lose on the laches." (p 5) - When Benson's lawyer argued the burden on the State: "You're arguing practicalities. But you know what? I have to comply with the law. I have to follow the law." (p 11) - On calling out the State's specious claim that a clerk can't bring this case: "I'm with you on that. You're right." (p 16) - The State's own lawyer, on the record: "You're not going to hear a merits argument from me." (p 11) WHAT'S NEXT: The State now has to defend the rule on the merits, which it has AVOIDED SINCE THE START. Benson's lawyers promised in court to issue rulings on her requests within two weeks. BENSON'S SECRET EMAIL. TIME TO ADMIT OR DENY. Michigan Secretary of State Jocelyn Benson did government business from a private email address. Including with the Southern Poverty Law Center, her former employer, now under FEDERAL INDICTMENT for wire fraud and money laundering. Now she wants to be your next governor. A private email for state business. You've heard this one before. Former Michigan Attorney General @Mike_Cox, my client and co-counsel, asked for the records. Her own Department BLACKED IT OUT. Refused to say why. For 49 days. Then a city clerk in Rochester Hills produced this in TWO BUSINESS DAYS. An official election meeting with other states' election chiefs. Sent to her Gmail. All of this is in court filings. Links at the bottom. Read them yourself. Why does one address matter? Because state business done on a secret account is SECRET GOVERNMENT BUSINESS. Every email sent through it is a public record the public can't see and the state NEVER SEARCHED. And that's the one we know about. And to ORDER the Department to hand the blacked-out pages over to him so he can see for himself. And she has 20 questions to answer. In her own name. By October 14. I want Mike Rogers to win. Every serious Republican does. That's why I'll say it again: labels don't win Michigan. Reasons do. Kaitlyn Buss got the big one right in the Detroit News this weekend. Rogers and Republicans must tell Michigan what they're FOR. Confront El-Sayed's ideas. Make the affirmative case on affordability, healthcare, housing, energy prices, and data centers. Like it or not, that's what voters care about. Deal with it instead of ignoring it. Ignore it and you don't win. But here's the half the column keeps missing: it's not just how you win the argument. It's how you win the turnout. 564,726 Republicans went missing last Tuesday. Fear won't bring them back to the polls. A reason will. As I've said, no one crawls over glass to vote AGAINST. People crawl over glass to vote FOR. Give real reasons. Give voters something to vote for, and mean it. Unity is built, not simply declared. And it is built by candidates earning voters, not by voters being told to fall in line (hint: that never works). And run on the real clock, not the calendar. There's no time. Those first ballots go out to our military and overseas voters in just 40 days. Every other absentee ballot follows days later. The primary just proved most votes get banked long before election day. Whoever waits for October will be talking to people who already voted. My Saturdays this fall go where the fights can be won: the State House firewall and the university boards. We just took the next step! @stephiebeltinck and @ShellyLake13 are appealing the Bureau of Elections’ Aug. 31 dismissal of our four HAVA complaints. •Two of those complaints named Jonathan Brater as a respondent. The Bureau said he had been isolated. Then he presided over the July 9 hearing, noted our recusal request, and later signed the determination dismissing the complaints against the Bureau, the Secretary, and himself. •That’s not the end. That’s why you appeal. A circuit judge who didn’t write the deletion memos, didn’t sit as a named respondent, and didn’t lose audio mid-argument now gets the record: the complaints, the hearing transcript, the exhibits, and the law Congress actually wrote. The questions are simple: •Can the person complained about decide the complaint? • Did Michigan follow HAVA’s Title III rules on audit capacity, voter-file accuracy, coordination, and record preservation? • Was “we dispute that” enough to close the file? 🇺🇸 Lawyers aren’t free and we’ve retained a good one!
